After the landmark ruling passed by the Spanish Supreme Court in 2015, customers were refunded 40,000 euros and granted timeshare releases – after timeshares were mis-sold.
This ruling along with other major judgments has meant that customers are entitled to timeshare releases and claims against resorts such as Club La Costa under the following circumstances:
In recent months there has been a ground-breaking ruling against Club La Costa in which a client was given a complete refund of the purchase price along with a proportion of maintenance charges, his agreement was cancelled and he was granted a timeshare release.

High pressure selling at it’s worse.
If something sounds too good to be true, it usually is.
I received a phone-call offering me a week’s holiday at this resort for £99. We had to find our own flights and transfers. The offer was for self-catering and I was told we would have to give up a morning or afternoon of our time to attend a presentation. As with all these things, we had to decide there and then to get the offer so there was no time to check the internet for reviews.
Checking in was a delight and a porter delivered our luggage to the apartment. So far, so good. The apartment was lovely. It was showing it’s age a bit, but there was a fully equipped kitchen with dishwasher, toaster, microwave, washing machine and full fridge. There was a welcome pack with milk, orange juice, water, bread, and sachets of coffee, tea and sugar with mini pots of margarine and jam. There was a full dining table with chairs plus a really comfy 2 seater sofa and chair. The t.v had satellite channels including English football matches, BBC, ITV etc. We had a two bedroom apartment with the main double having a full en-suite with bath and the second twin room had a separate shower room. There was also a free safe available. We were delighted.
Outside there was a fully furnished patio area, an area of grass and a heated swimming pool shared between just a few apartments. It was rarely busy.
The beds turned out to be too hard for a good night’s sleep, as were the pillows. We ate a few times at Zacary’s bar which had average tourist food at higher than average prices but as the complex is almost mid-way between Fuengirola and La Cala de Mijas, sometimes it was just easier to stump up. The staff were friendly and football was showing on multiple screens which we appreciated. There is also happy hour 2 for 1 between 5.30 and 6.30 on drinks.
The complex is set on a hillside so there are lots of steps or slopes. Luckily, we stayed in the Castilla del Rey area which was close to reception and Zacary’s. We didn’t use the resort train but were told the diesel fumes made a ride unpleasant. It also seems to go one way around the whole resort so depending on where you wanted to go, it could take some time. It passed each point every half hour.
We are not the type to stay in resort all the time so we went to Fuengirola most days and once to La Cala de Mijas. The first time we went to Fuengirola we took the bus and this was a mission with a disabled person. Getting to the bus stop was the first problem, then getting on and off the bus. We returned by taxi and didn’t bother with the bus again.
The beach to the front of the resort is not very nice, just a thin strip of sand below the walls of the dual carriageway. The road noise didn’t bother us at all whilst in the resort as it is set down.
Then the whole thing is totally ruined at the presentation. We were collected by Paul at 9 am and taken to the Safari restaurant at the other end of the resort. The good-natured questioning started as soon as we got in the car. Paul was lovely with impeccable manners. We had a buffet breakfast which was very nice, but all the time, Paul was with us, with the subtle questioning and being put at ease continuing. We were introduced to a woman who appeared to be one of the main salespeople. The ones who pick you up are the nice guys! We were then taken to a large room filled with desks, computer screens and chairs. We were shown to one desk and there were various other groups of people at other tables. If you have children, unless you have someone to look after them, they will be with you throughout. It made me laugh afterwards to read about an excursion which included a 30 minute presentation on health foods and was therefore deemed unsuitable for children. We were told by the saleslady that everyone there is very nice, there is no high-pressure selling and they understand that sometimes the product just doesn’t suit. This is a lie.
Our circumstances had changed since we booked the trip and the product was totally unsuitable. Typically, all the pro’s are drip-fed to you and the cost part is almost brushed over. We finally got to the 999 Euros per year maintenance charge, then another £125 to have a membership to more variety of resort, then another £75 if you wanted to use their hotel partners (all top notch). This was without buying anything at all. It was by now 1.30pm and we had had enough. The morning had come and gone and we still had 3 types of accommodation to look at followed by further discussions about costs. I refused point blank. This was when the threats started coming. I had contracted to the entire presentation, I was informed. I was told it would be a morning only. By my reckoning, morning ended at 12 and I had already given 90 minutes more than I contracted to, but no, the sales bit only started at 11 because we had been at breakfast beforehand and the small print said otherwise but as a favour, because it was so obviously not for us, we only had to look at one type of property, which, after my husband became so concerned that we would be charged full price for the holiday, I reluctantly agreed to do, wasting even more of our time.
If you do a bit of research, despite all the reassurances, it is VERY difficult to get out of one of their contracts although CLC World lost a major court case in October 2015 and had to pay back all the money paid by one client, plus court costs. It also seems very difficult to actually get a holiday with your points and you have to pay yet more money every time.
You get no choice on the day or time of the presentation so do not pre-book excursions.
All in all, we had a good time but I wouldn’t go back to this or any other CLC resort even if it was totally free with flights and transfers paid.

Cheap time share offer to view the resort
Received a random phone call in April to experience Costa world. £99 out of season £199 peak
. We were told we had to go for a 2 hour presentation for this offer which we took up.
Firstly the resort is on a busy dual carriageway very noisy, plenty of bridges to cross to a below standard beach. 30 minute walk to the centre or £1.50 for a regular bus each way.
The accommodation was 2.5 star although the facilities are much higher including on-site restaurants reasonably priced. There are many resorts in 1 huge complex.
Timeshare pitch, although now called fraction ownership, was at least 3 hours, some couples stayed for 6 hours. The pitch is a one-to-one basis. I won’t discuss pricing although if you purchase on the day there is a really good offer. Very friendly sales pitch not pushy but they won’t like a no.
They show you a state of the art apartment to get your juices flowing. Good local transport to nearby places. €45 each way to the airport. Prices have risen in the past few years, local shop a bottle of wine €3, restaurants €15.
So standard accommodations
We came here for the second time having bought a trial pack for 5 weeks holiday. Had a prelude holiday on February and was given a place at Sta Cruz which was a 2 bed with Jacuzzi. It was indeed a good apartment during that time. But as all know, they were trying to sell you to join in this membership thing, showing off what you can get as a member. When we said we aren’t interested to joining, coming back for this April we were given a 2 bed apartment in a secluded area. The parking is gated, very old, the lift takes only 4 people. The apartment itself is clean but the problem is you can hear everything from the neighbours when people are talking, moving their furniture, the tv. It’s horrible. The bed even squeaking when you move. There weren’t any tv in the room only on the lounge. We complained and was given an option to move to a more secluded area without a view and so we stayed in for 7 days unhappy. It was very standard the accommodations which is not worth the price we paid for a trial of 5 week holiday. Then again we attended a follow-up meeting which we refuse to sign up. Omar the representative was very polite and he did understand our situation, not insisting for us to sign. We were not happy of the accommodations that was given to us on trial membership. Not worth the money. You can find a better place than Marina Del Sol for a better holiday. Still have 4 weeks holiday with ClC world, I bet they will give us the standard one next time around again with this review. We are not happy taking the trial
So glad to be home!!!
Despite having no plan to purchase a timeshare, we decided to take the Promotional holiday offered at Marina del Sol near Fuengirola and find out what it was all about.
We booked 9 months in advance and were reassured on several occasions that we would get an apartment with twin beds for our children as they would not sleep together; when we arrived we were given their oldest, dirty apartment with a double bed. In addition, despite them knowing we had a 5 year old, they put us in a top floor apartment with no air conditioning and fans that barely turned around so the temperature never dropped below 29 degrees. When we asked for a room change they said this wasn’t possible and we would have to discuss our problem at the promo meeting which was arranged for the day after our arrival.
Breakfast was wonderful, and the kids were given iPads to play on whilst CLC looked in to changing our room and did the hard sell, but after 3 hours, the kids had had enough. We asked repeatedly how many points we would get for our budget, but were told over and again that they would tell us soon. We never did find out. After 5 hours they finally got the message we weren’t going to sign up to anything and let us leave.
So we were stuck in a boiling hot room, afraid the little one would tumble off the balcony, and then they switched off our water! When we asked what had happened they said the whole resort was without water, but we thought this strange as the showers and toilets at the pools were working. When we got chatting to some of the other holidaymakers they said their water was still on!
So it turned out to be a stressful week in hell! Our youngest child had heat rash and cried all night because he was hot and itchy, thankfully only one of his toys fell off the balcony and not him, and we weren’t able to shower until the ‘water came back on in the resort’. We ended up spending a small fortune to get a last minute apartment in another resort which had air conditioning so we did at least get some sleep.
Really dirty tactics from this terrible company. Instead of enjoying a relaxing cheap week, it ended up being one of the most stressful and expensive weeks of our lives. Avoid CLC at all costs. We could have had a package deal for a lot less than we ended up spending.
OK "CLC Marina del Sol" Resort, too bad it is so close to a very busy high way
Just to put things in perspective; we stayed the last week of April, we booked a two bedroom apartment at € 300,- and had to pay onsite an additional € 30,- for utilities. (Then again, I notice on TripAdvisor it can come at an even better rate, and it was far from high season at the “Costa del Sol”.) The apartment was OK, airconditioning downstairs and in 1 bedroom, the other had a ceiling-fan. There is no dishwasher, but the apartment was cleaned twice during our 1-week stay. Staff at the resort were very friendly.
Why then only 2 dots….. Well very simple. Our apartment was almost at the highway, and not well insulated for the noise that brought. The highway is busy 24/7, so our sleep was negatively affected by it. (and the apartment next to use was being renovated which brought additional noise.) The highway separates the resort from the beach, but the beach is far from pretty. And although the resort advertises with “21 swimming pools”, you are only allowed to use a few depending on which area your unit is. And for us that meant only one – very crowded – heated pool. Towels are for rent @ € 1,50 per towel per week.
Entertainment program very limited (especially compared to Iberostar where we stayed afterwards).
Finally – internet unacceptably poor connection & log-on protocol. Had to re-log-on every 5 minutes or less, and very often connection too poor to work on. (meaning a lot of roaming on my 4G).
So – even at a low price, for us the value for money was not OK. Yes – there are more resorts around that part of the “Costa del Sol” that are close to the highway, but it doesn’t mean that “then” it is OK.
We would not go again.
